The Georgia Supreme Court has unanimously upheld a $40 million verdict against Fiat Chrysler over a defectively designed rear-mounted fuel tank. The verdict was awarded to the parents of a 4-year-old boy, Remington "Remi" Walden, who was burned alive after the family's Jeep Grand Cherokee was rear-ended and erupted in flames. The 2012 post-crash fire is similar to the one that claimed the life of Beasley Allen clients' daughter, Erica Scannavino, which occurred five years later. We filed the Scannavino lawsuit last year to hold negligent companies accountable.

March is brain injury awareness month. Some of our clients have suffered traumatic brain injuries and we have discussed some of the causes and long-term effects of the injuries. The Alabama Head Injury Foundation is one of only two resources in Alabama providing services to meet some of the needs TBI victims and their families require each day. Several of the firm’s attorneys serve on the group’s boards and actively help the group raise awareness about brain injuries. AHIF's executive director talks about the group’s work.

Preventable harm and medical error remain major sources of injury and death among nursing home residents and hospital patients, according to the Institute for Healthcare Improvement. During Patient Safety Awareness Week, the IHI is encouraging health care professionals, patients, and caregivers to speak up and ask questions to advance a safety culture in health care. We have filed the firm's fifth lawsuit against opioid manufacturers and distributors on behalf of an Alabama city or county government. The suit alleges the marketing of these drugs contributed to the creation of the opioid epidemic, a public health and safety crisis. Responding to the opioid crisis has required the city to sustain economic damages and to continue to bear a significant financial burden. We have filed similar lawsuits on behalf of the City of Greenville, Houston County, Barbour County, and Limestone County, Alabama, as well as Sumner County, Tennessee and we are representing the State of Alabama in its opioid lawsuit against Purdue Pharmaceuticals.

Congress is considering bills that would let Equifax and other credit bureaus and financial institutions off the hook in future if they are hacked. It hasn’t even been a year since Equifax’s poor software management allowed hackers to steal the sensitive information of more than 145 million U.S. consumers. Yet, lawmakers may choose to give these companies a pass rather than protect consumers. If so, consumers could be forced to pay for credit freezes after a breach and the protections offered to consumers by state laws would be worthless.

The opioid crisis is taking an enormous toll on human life and the economies of cities and towns throughout the country. Beasley Allen lawyer LaBarron Boone is part of the firm's opioid litigation team representing the State of Alabama as well as cities, counties and medical providers such as mobile emergency rescue squads, in their fight against opioid makers and distributors. Andrew E. Brashier was a panelist during the #FalseClaimsAct Today CLE earlier this week and spoke about qui tam or whistleblowing cases from the perspective of the whistleblower. Thanks to the Middle District of Alabama and the Federal Bar Association for hosting the event. A number of Andrew’s Beasley Allen law partners attended, too. The event was the first time each U.S. Attorney’s Office in Alabama has had a representative in a single venue for attendees to ask questions about how they review and investigate qui tam cases. U.S. District Chief Judge W. Keith Watkins of the Middle District of Alabama provided invaluable insight on his view from the bench and Burr Forman attorney, Tom Potter, provided the defense bar’s perspective.
