This reform is needed. The consecutive stacked minimum mandatory sentences were not intended by the legislature and has been abused by the courts. The judge should have discretion to decide how it applies. Firearm Recidivist Sentencing Act (will be introduced today) Introduced by Rep. Robert C. “Bobby” Scott (D-VA). Amends § 924(c) to remove: (a) 5-year mandatory minimum sentence for carrying a firearm while committing a violent crime or drug trafficking offense; (b) the 7-year mandatory minimum sentence for brandishing a firearm during the offense; (c) the 10-year mandatory minimum for discharging a firearm during the offense; and (d) the 25-year mandatory minimum sentence for repeat offenses. Amends § 924(c) to ensure that this mandatory consecutive enhancement applies only if the defendant has been previously convicted and released on a sentence for a § 924(c) offense. Amends § 924(c) to remove the death penalty. Provides retroactive relief.
