Hold the phone. Did Colorado just make it legal to text and drive? A new law in Colorado has increased the penalties for texting while driving to a maximum fine of $300 and up to 4 points on a driver’s license. At the same time, it has softened the state’s standard for such behavior. Texting while driving is now illegal only if an individual is doing it in “a careless or imprudent manner.” Many people are concerned that this law is going to send the wrong message and move the state in the wrong direction, as states besides Colorado are toughening their laws to discourage cellphone use by drivers. Officials in Colorado have even acknowledged the fact that this is going to make it harder to issue citations and punish motorists who are texting, due to the interpretive nature of the phrase “careless manner.” Officers now utilize a two-part test before issuing a citation. It also leaves much of the charge based upon the discretion of the officer, as they are the ones who can decide whether a driver’s behavior was careless. The Law Offices of Stephen J. Man jailed for 17 years until lawyers find look-alike convict with same first name Richard Jones reportedly spent almost 17 years in jail for robbery until his conviction was tossed out when it was discovered that another man looks identical to him. Jones denied involvement in the robbery and alerted his lawyers when he first heard that someone that looked exactly like him was in the same prison. The only evidence linking Mr. Jones to the crime was witness identification. When the photos of the two men were shown to the victim, witnesses and prosecutor, none of them could tell the two men apart. This information was then brought to a judge, who freed Jones since it was now unclear who committed the crime. On Oct 1, 1984, Catherine Fuller was attacked and beaten to death in an alley in Washington DC. Prosecutors obtained two guilty pleas and eight convictions from those accused. Later on, it came to light that the Prosecutors were withholding evidence that could have potentially exonerated the defendants. Some of the evidence showed that a different man had committed several similar acts in the area, around the time of the incident. Other evidence was an eyewitness account describing one man attacking Fuller, not ten people. Even with such blatant violation of legal procedures, a 2014 study showed that 86 percent of cases with withholding evidence violations did not prevail on appeal. Former Power Ranger actor Ricardo Medina has pleaded guilty to killing his roommate, Joshua Sutter, with a sword. The incident happened in 2015 at a house in Green Valley, north of Los Angeles. Medina had originally claimed self-defense but an autopsy report showed the Sutter had wounds consistent with defensive wounds, implying he was defending himself against Media. Colorado Bill Would Increase Penalties for Texting While Driving form $50 to $500. Senate Bill 27 would increase the penalty for texting while driving to $500 and five points on a driver’s license for a first offense. Buckling up, however, remains a wise idea. I deal with auto accidents every day. The people who are seriously injured are not wearing their safety belt.
