On September 5, 2017, President Trump announced that the Deferred Action for Childhood Arrivals (DACA) program will be ending. This impacts almost 800,000 young people who entered the U.S. before age 16 who had temporary protection from deportation and work authorization. While Congress may act and pass a permanent protection for Dreamers, here is what you need to know right now: 1. New applications are no longer being accepted by USCIS. 2. DACA that expires on or before March 5, 2018 can be renewed if the application is received on or before October 5, 2017. 3. DACA that expires after March 5, 2018 cannot be extended. 4. Pending DACA applications received at USCIS on or before September 5, 2017 will continue to be processed. Talk to an immigration lawyer as soon as possible. You may be eligible for another type of status.

NO ARIZONA IN-STATE TUITION FOR UNDOCUMENTED DREAMERS On June 20, 2017, Judge Kenton Jones in the Arizona Court of Appeals ruled that the 28,000 undocumented immigrants (shielded form deportation under the 2012 Deferred Action for Childhood Arrivals (DACA) Program) pursuing higher education at public universities across Arizona no longer qualify for in-state tuition. The state appellate court overturned a lower-court judge's 2015 decision that young immigrants known as "dreamers" were considered legally present in the U.S. and therefore qualify for state benefits. Presiding Judge Kenton Jones wrote that the DACA Program, signed into law by former President Barack Obama, did not confer that status. He said federal immigration law allows each state to decide on optional benefits for DACA recipients, and Arizona law bars in-state tuition. Department of Homeland Security officials have emphasized that work permits granted to people approved for DACA bestow legal presence, but not legal status. The state challenged the tuition breaks in 2013 after Maricopa Community Colleges, Arizona's largest community-college system, allowed dreamers with work permits to pay in-state rates. Dreamers have been able to receive lower, in-state tuition rates at the state's three universities — Arizona State University, University of Arizona and Northern Arizona University — since 2015. The rates are substantially less than what non-resident students pay. About 240 current DACA students at the state's universities and a little more than 2,000 DACA students in Maricopa Community Colleges are receiving lower, in-state tuition rates. DACA recipients won the right first to obtain diver's licenses in 2014.

The U.S. Embassies around the world have started using a new supplemental 3-page questionnaire asking visa applicants for 15-year travel and employment history, 15-year residence history and user names on all social media accounts visa applicants have used in the last five years. The intention is to identify applicants who spent time in areas controlled by terrorist groups such as the Islamic State or al-Qaeda. The additional questions will not be asked of all applicants, just those who consular officers determine merit a more “rigorous” evaluation. The State Department estimates that about 65,000 of 13 million visa applicants every year could be subjected to the extra scrutiny.

ICE announced a six-week nationwide gang operation led by ICE's Homeland Security Investigations concluded with 1,378 arrests across the United States. Of the 1,378 total arrested, 445 were foreign nationals from 21 countries in South and Central America, Asia, Africa, Europe and the Caribbean. Three individuals arrested previously had deferred action under DACA. Ten individuals arrested during this operation crossed the border as unaccompanied minors. Nine of the 10 were confirmed as gang members, eight of whom were MS13 gang members.
