A law was recently passed in Alabama, which goes into effect on January 1, 2017 regarding common law marriages. No common law marriages may be entered into on or after January 1, 2017. However, any common law marriage entered into prior to January 1, 2017 shall remain valid. #alabamalaw #commonlaw #marriage

Legal Scribbling: The most important element to prove a common law marriage is public recognition of the marriage. Evidence tending to establish public recognition includes joint tax returns filing as married, introducing each other in public as wife/husband/spouse, telling friends and associates that you are married, using partner's last name, any writing submitted to others indicating he/she is your spouse, etc.

A jury verdict in a civil case must be unanimous. In other words, all 12 members of the jury must agree. After deliberating for some time, if the jury reports to the judge that it is hopelessly deadlocked, then the judge may 1) declare a mistrial, 2) ignore the statement of the jury and have it continue to deliberate without comment, or 3) give a "dynamite" charge to the jury, whereby the court requests the jury continue deliberating to reach a verdict to avoid retrial.

In divorce cases, generally the judge decides initial child custody based on the best interest of the child. Once a judge issues an order awarding primary custody to one parent, and the non-custodial parent later desires to modify custody, the non-custodial parent generally has to prove a material change of circumstances has occurred that overcomes the disruptive effect of uprooting the child.
