This is the unoffical start of H-1B season. For those employers and employees who wish to apply under this year's H-1B visa lottery, now is the time to begin assembling educational and immigration related documents to be submitted with the petition on April 1st.

The State Department has now introduced a two tier system for priority dates - one is a filing date and the other is a final action date. As a result, many eligible beneficiaries of approved petitions can now file earlier for adjustment of status to permanent resident. So even with a backlog for final action, they and their family members could still receive employment and travel authorization within a few months.

Reminder: The deadline to file cap subject H-1B petitions for this season is fast approaching. We should be working on the LCA (Labor Condition Application)phase soon as it takes 7 days to get certification. We will be sending the completed petition packets off via FedEx on March 31st to meet the April 1st deadline.
