A delegation of Winnebago tribal and business leaders traveled to the State Capitol on Tuesday to educate legislators about the economic renaissance taking place on their northeast Nebraska reservation. The delegation, which included Winnebago tribal Chairman Frank White, Councilman Jim Snow and Ho-Chunk Inc. CEO and Fredericks Peebles & Morgan partner Lance Morgan, attended a luncheon for state senators hosted by Tom Brewer, the state’s first Native American lawmaker. Mr. Brewer, a Republican, is a citizen of the Oglala Sioux Tribe.

FPM was proud to work in conjunction with the U.S.Department of State to host members of the Global Ambassadors Program for a discussion about tribal jurisdiction, the Violence Against Women Act, and sex trafficking in Indian Country. The Global Ambassadors included attorneys, advocates, law enforcement officers, and government officials from Guyana, Canada, Italy, Solvenia, Macedonia, and Brazil. These future world leaders were very honored to learn about tribal sovereignty, tribal treaties, and modern day tribal governments.

Many patent owners are looking for ways to defend against inter partes review (IPR) challenges to their patents. Pharmaceutical company Allergan made headlines last year when it transferred its patents for its drug Restasis to the St. Regis Mohawk Tribe in an attempt to shield the patents from IPR challenges by using the tribe's sovereign immunity. This move increased interest in potential patent deals with Native American tribes, but also drew negative reactions, including from members of Congress and the Federal Circuit judge handling the related district court litigation. Against this background, our webinar will explore these topics: • An overview of tribal and state sovereign immunity and their limitations • The law of sovereign immunity with respect to IPR proceedings • Can one purchase (or rent) sovereign immunity?
