All pro se (unrepresented) parties are required to present to the Court the recommended maintenance calculation in Colorado. However, we have found that blindly following this recommendation can lead to unintended results for both parties. The new Colorado Statute providing "advisory guidelines" will be effective for cases filed with a Colorado Court after December 31, 2013. The statute provides guidance to courts and parties regarding not only the amount of maintenance but also the recommended length of time. Text of the statute is more than twenty pages but we will try to provide some general guidelines in the coming days.

Much discussion these days regarding the new Colorado spousal maintenance guidelines scheduled to take effect January 1, 2014. We will post more in depth discussions of the statute, but for now wanted to post a quick link to the actual statutory language:

It is that time of year again. If you are considering a divorce in Colorado, September is the last month to file your Petition and afford yourself a choice with regard to your tax filing status. The IRS will examine your marital status on the last day of the year to determine marital status for the entire year. At Divorce Resolutions, we consistently help clients evaluate that most favorable filing status, many times saving the couple more than the cost of the whole mediation process.

While not applicable to civil unions, IRS ruled today that all legally married couples (including same sex couples) will be treated as married for federal tax purposes. This filing status will apply even if a couple resides in a jurisdiction that does not recognize same sex marriage. This even applies to married same sex couples who may be able to amend their tax returns for years 2010, 2011 and 2012, resulting in a potentially significant refund. For divorcing same sex couples this change in policy will significantly increase the options at divorce for taxable support as well as the allocation of assets.
