PSA for Harvey victims, please share (this is "tort reform" at its finest...) Texas House Bill 1774 impacting claims made by Harvey victims goes into effect 9/2. Most of you who have been damaged by Hurricane Harvey have probably never heard of HB 1774. So WHY does this law matter to people who suffered property damages from Harvey? During the 2017 Legislative Session, state lawmakers made some significant changes to the laws that are supposed to protect and help property owners recover for losses after a storm like Harvey. These changes are not friendly to property damage victims and can significantly hamper your ability to hold your insurance company accountable if they slow pay, low pay, or no pay your otherwise valid claims. Should you need a lawyer to help resolve your claims, you might also be unable to recover some or all of your necessary attorneys fees in a dispute with your insurance company thanks to the new law. If your property was damaged the time to act is NOW. The new law goes into effect SEPTEMBER 1, 2017. This law will make it harder for you to get a timely, fair payment on your claims, but if you provide notice of your claims NOW, you can take advantage of the old law. To take advantage of current Texas insurance law protecting property owners’ with regard to damage claims resulting from Harvey, policyholders MUST send a written message or email directly to their insurance company that specifically references their claim; AND is dated BEFORE SEPTEMBER 1, 2017. I would encourage anyone effected by Harvey to send an email and a letter through US Mail with delivery confirmation to their insurers. Telephone messages are not adequate to give written notice. You should also keep a copy of whatever you send to your insurance company. Doing this will protect your rights should your insurance company (rather predictably) low pay, slow pay, or no pay your valid claims. Once August 31 passes, you will be stuck in the same battle with fewer remedies available to you. Give notice NOW. Along with other useful information, fax numbers and addresses of where to send the notice of claim can be found at http://www.tdi.texas.gov/ "

The Board is an advisory group to Mercer Law Dean Cathy Cox. Brandon graduated magna cum laude and first in his class from Mercer Law in 2004. Butler Wooten & Peak LLP is pleased to announce that the firm settled a whistleblower case brought under the federal False Claims Act against Wells Fargo for $108 million. The case involved Wells Fargo charging veterans unallowable fees on a classification of VA mortgage loans called “IRRRL” loans. The VA guarantees a substantial portion of these loans, thereby reducing the bank’s risk. On behalf of our clients, we sought repayment of the guarantees that Wells Fargo collected on loans that went into default and foreclosure. Wells Fargo should never have received those payments from the Government if it would have truthfully informed the VA that it had charged veterans unallowable fees and falsely certified compliance with VA regulations. The overwhelming majority of this settlement will be returned to the Government, which reduces the burden on taxpayers. It is our hope that the VA will use this money wisely to help our nation’s veterans. This is the largest result from the 11 year-old lawsuit. The five banks that previously agreed to settle are Countrywide Home Loans, Inc. ($45 million), PNC Bank ($38 million), First Tennessee Bank ($16 million), SunTrust Mortgage ($10.2 million), CitiMortgage ($7.5 million), and JP Morgan Chase ($45 million). Butler, of Butler Wooten & Peak, said he made the lead gift in memory of his father, Lt. Cmdr. James Butler Sr., who flew fighter planes in the U.S. Navy in World War II and died last year. "Dad always taught us that anything worth doing was worth doing right," Butler said. "This clinic provides two useful services," Butler said. "It helps veterans, which is pretty dear to my heart, and it also gives law students clinical training, which is something Joel (Wooten) and I have been preaching to UGA Law School for over 20 years."
