Today's Tip: Bench Warrants- Many people are shocked to learn there is an active bench warrant for their arrest. The most common reason this happens is failure to appear (FTA) for a scheduled court date. Often, the person has moved and court mail is not forwarded. So, innocent people find themselves with a warrant just because they did not receive a notice with a court date. It is important to make sure that if you have any criminal/ criminal traffic/child support hearing matter pending, make SURE you update your current address with the court and obtain verification of that update. DUI TIP: Sobriety Checkpoints: As we approach the holiday weekend, police are setting up checkpoints to catch intoxicated or impaired drivers. TIP: police officers are ONLY allowed to ask you questions about your identity like your name and address. You are NOT required to answer other questions like "where are you coming from?" or "where are you going?" It is best to politely decline to answer these types of questions. The purpose of a DUI/DWI checkpoint is to catch drivers who have been drinking and any information can be used against you! If you are arrested for DUI/DWI, I can help. DRUNK DRIVING alert: Most people are shocked to learn they can be charged and convicted of DUI while sitting in their parked car even if the engine is OFF! Maryland courts interpret the phrase "operating a motor vehicle" more broadly than simply the act of driving. So, if you've had too much to drink and want to sober up in your car before driving, make sure the keys are NOT physically in the ignition. To be extra safe, don't sit behind the wheel. Today's' Tip: If you are charged with DUI and refuse the breathalyzer test, you may be subject to a suspension by MVA and possible jail time by the court. However, in the realm of refusal, there is a difference between outright refusal to blow versus supplying an inadequate breath sample. The State treat both as a refusal though defenses exist in each case. For MVA, one option is that you can forego a hearing altogether and opt to have an interlock device installed in your vehicle for one year. Sometimes, not always, this is the best option. How to Avoid a Bench Warrant: "Regular" people get bench warrants issued for their arrest every day in Maryland. Why? Something as simple as moving to a new address causes otherwise law abiding people to get arrested. How? If you move and don't notify the court of your new address and the court mails a notice to appear to your old address, you probably won't get that notice because court mail does not get forwarded. So, when you miss your court date for a required appearance, the Judge issues a bench warrant. So, if you have any pending court matters, always make sure to update your address with the court to avoid a bench warrant.
